PDF Connect Terms of Service

1. Introduction​

Welcome to PDF Connect ("the App," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our application and services available through the Shopify App Store.

By installing or using PDF Connect, you agree to be bound by these Terms. If you do not agree to these Terms, please do not install or use the App.

2. Description of Service​

PDF Connect provides merchants with the ability to:

  • Upload and store PDF files
  • Link PDF files to Shopify store resources (products, pages, collections, articles, blogs, homepage, search)
  • Display PDFs to store visitors using customizable viewer blocks
  • Manage PDF libraries and linking configurations

3. Eligibility​

To use PDF Connect, you must:

  • Have a valid Shopify store
  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the authority to bind the entity you represent (if applicable)
  • Comply with all applicable laws and regulations

4. Account and Access​

4.1 Shopify Authentication​

Access to PDF Connect is provided through Shopify's OAuth authentication. You are responsible for maintaining the security of your Shopify account credentials.

4.2 Account Responsibility​

You are responsible for all activities that occur under your account and for ensuring that all users of your account comply with these Terms.

5. Acceptable Use​

5.1 You Agree To:​

  • Use the App only for lawful purposes
  • Upload only content you have the right to distribute
  • Respect intellectual property rights of others
  • Maintain accurate account information

5.2 You Agree Not To:​

  • Upload illegal, harmful, threatening, abusive, or otherwise objectionable content
  • Upload content that infringes on copyrights, trademarks, or other intellectual property rights
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the App to distribute malware, viruses, or other harmful code
  • Interfere with or disrupt the App's services or servers
  • Reverse engineer, decompile, or attempt to extract source code from the App
  • Use automated systems or software to extract data from the App
  • Resell or redistribute the App without authorization

6. Content and Intellectual Property​

6.1 Your Content​

You retain all rights to the PDF files and content you upload to the App ("Your Content"). By uploading content, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service.

6.2 Our Intellectual Property​

The App, including its design, features, functionality, and documentation, is owned by PDF Connect and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the App.

6.3 Content Responsibility​

You are solely responsible for ensuring that Your Content:

  • Does not infringe on third-party rights
  • Complies with all applicable laws
  • Is appropriate for your intended audience

7. Subscription Plans and Payment​

7.1 Free and Paid Plans​

PDF Connect offers both free and paid subscription plans. Features and limitations vary by plan level as described in our pricing page.

7.2 Billing​

Paid subscriptions are billed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your payment method.

7.3 Cancellation​

You may cancel your subscription at any time through the Shopify admin. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be provided for partial billing periods
  • Your data will be retained for 30 days to allow for reinstallation

7.4 Price Changes​

We reserve the right to modify our pricing. We will provide at least 30 days' notice before any price increase takes effect.

8. Service Availability​

8.1 Availability​

We strive to maintain high availability but do not guarantee uninterrupted access to the App. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or repairs
  • Factors beyond our control (internet outages, third-party service failures)

8.2 Modifications​

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes.

9. Data and Privacy​

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Disclaimers​

10.1 "As Is" Service​

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee​

We do not warrant that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Results obtained from the App will be accurate or reliable
  • Any errors will be corrected

11. Limitation of Liability​

11.1 Limitation​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PDF CONNECT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

11.2 Cap on Liability​

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification​

You agree to indemnify, defend, and hold harmless PDF Connect and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your Content

13. Termination​

13.1 By You​

You may terminate your use of the App at any time by uninstalling it from your Shopify store.

13.2 By Us​

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

13.3 Effect of Termination​

Upon termination:

  • Your right to use the App ceases immediately
  • We may delete Your Content after 30 days (unless earlier deletion is required by law or requested by you)
  • Provisions that by their nature should survive termination will survive

14. Dispute Resolution​

14.1 Informal Resolution​

Before filing any formal dispute, you agree to contact us at hello@apptall.com to attempt informal resolution.

14.2 Governing Law​

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14.3 Jurisdiction​

Any disputes arising from these Terms shall be resolved in the courts located in the United States.

15. General Provisions​

15.1 Entire Agreement​

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PDF Connect regarding the App.

15.2 Severability​

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

15.3 Waiver​

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

15.4 Assignment​

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Notices​

We may provide notices to you through the App, via email, or through your Shopify admin.

16. Changes to These Terms​

We may update these Terms from time to time. We will:

  • Update the "Last Updated" date at the top
  • Notify you of material changes via email or in-app notification
  • Post the updated Terms on this page

Your continued use of the App after changes constitutes acceptance of the updated Terms.
